German Immigration Law 2023 for Skilled Immigrants

The German immigration law will be enforced starting Monday, November 27, 2023. This newly implemented law is supposed to fulfill the lack of professional and skilled labor in the German Labour Market by attracting immigrants.

According to statistics, German companies currently have about 1.73 million job vacancies. But how important is this new law for the economy of this country?

According to the statistics published by the German Labor Office, foreign workers make up about 15% of employees with social service insurance. Also, according to official statistics, one out of every seven workers in Germany has an immigration background. The German government is considering introducing an immigration law for skilled workers to ensure the continued migration of skilled and trained workers to this country.

 What is different between the new and the previous laws?

The difference is introducing the so-called “opportunity” card, which follows the scoring system. Hereafter, skilled workers who want to work in Germany and intend to immigrate to Germany with the help of this law must fulfill the following criteria:

  • Prove their language skills
  • Demonstrate professional experience
  • Meet age requirements for skilled immigrants, and
  • Fulfill other points related to the points system

In addition to the above requirements, the minimum wage required for immigration has also been reduced. In the future, skilled foreign workers can come to this country with a job offer of 4,3800 euros gross salary per year. Previously, for job migration, it was necessary to have a job offer with a gross salary of 58,400 euros per year.

Also, asylum seekers who entered Germany before March 29, 2023 (9 Hamal 1402) and who meet these conditions and have a job offer can apply for a residence permit as a skilled worker if they withdraw their asylum application. Previously, people had to leave the country and apply for a German work visa outside the country.

 Furthermore, according to the new law, anyone who comes to Germany as a highly skilled professional from a non-EU country can bring their spouse and children and their spouse’s parents to Germany. According to the recently released law, the livelihood fulfillment of the accompanying family members is an important criterion all applicants should meet. The parents who come to Germany cannot apply for services and social assistance.
